ISLAMABAD: The Islamabad High C
ourt (IHC) on Thursday barred the Election Commission of Pakistan (ECP) from action against Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan in code of conduct violation case.
The directives were issued after a hearing of the case in IHC by Justice Amir Farooq. PTI’s plea was accept
ed by the judge whereas the attorney general of Pakistan was summon
ed by the c
ourt for assistance.
The c
ourt said that the case faces significant
constitutional questions. PTI lawyer Dr Babar Awan presented his arguments in the case and was back
ed by Advocate Naseem Gondal. Awan took the plea that holding public rallies and meetings is a right of all political leaders. Imran Khan addressed a public meeting in a by-election wh
ich is a right of all political parties. According to
constitution that they can hold public gathering and the ECP through these three notifications is restraining the MNAs and MPAs from attending public meetings. The ECP notification is illegal and based on mala fide intention.
Justice Farooq inquired if the code of conduct was issu
ed by the ECP after election?
Seeking reply from the ECP the c
ourt adjour
ned the hearing until May 15.
